These Terms and Conditions (“Terms”) govern your access to and use of the OralDrills mobile application, the website at https://www.oraldrills.com/, and the lessons, audio, subscriptions, and related services made available through them (collectively, the “Service”).
OralDrills is the Google Play developer name and brand name. The Service is operated by M Vivishnabanu, the Google Play developer-account owner. In these Terms, “OralDrills”, “we”, “us”, and “our” refer to the operator of the Service.
Please read these Terms carefully before creating an account, purchasing a subscription, or using the Service.
1. Acceptance of These Terms
By creating an OralDrills account, purchasing a subscription, accessing lessons, or otherwise using the Service, you agree to be bound by these Terms and acknowledge our Privacy Policy.
If you do not agree to these Terms, do not create an account, purchase a subscription, or use the Service.
2. Age Requirement
OralDrills is intended only for users who are 18 years of age or older. By creating an account, purchasing a subscription, or using the Service, you confirm that you are at least 18 years old and legally capable of entering into a binding agreement.
If you are under 18, you must not create an account, purchase a subscription, or use the Service.
3. OralDrills Account
3.1 Registration Information
To create an account, you must provide a valid email address, mobile phone number, and password. Your email address and mobile phone number are mandatory.
You agree to:
- Provide accurate, current, and complete registration information;
- Keep your account information reasonably up to date;
- Maintain the confidentiality of your password and login credentials;
- Use only an account that belongs to you; and
- Notify us promptly if you believe your account has been accessed or used without authorization.
3.2 Account Responsibility
You are responsible for activity performed through your account, except to the extent that the activity results from a security failure for which OralDrills is legally responsible.
You must not share, sell, transfer, sublicense, or commercially distribute access to your OralDrills account or subscription.
3.3 One Account Per User
An OralDrills account is intended for the personal use of the registered user. We may restrict simultaneous, excessive, automated, or otherwise suspicious account access where reasonably necessary to prevent account sharing, fraud, abuse, or unauthorized access.
4. Educational Service
OralDrills provides spoken-English lessons, written learning material, lesson audio, oral-drill exercises, local voice-recording tools, and related educational features.
We may add, remove, correct, reorganize, replace, or update lessons, examples, audio, features, and course structures to improve the Service, correct errors, comply with law, protect security, or reflect changes in the curriculum.
Reasonable changes to individual lessons or features do not create an entitlement to a refund where the essential subscribed Service remains available, except where a refund is required by applicable law or Google Play policy.
5. Limited Licence to Use the Service
Subject to these Terms and any applicable subscription, OralDrills grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Service for your own non-commercial learning.
This licence does not transfer ownership of any course, lesson, recording, software, design, trademark, or other content to you.
6. Monthly and Yearly Subscriptions
6.1 Available Plans
OralDrills may offer monthly and yearly subscription plans. The features, duration, price, currency, applicable taxes, introductory offer, or trial—if any—will be displayed in the App and through the Google Play purchase interface before you confirm the purchase.
The price and subscription terms shown in the Google Play purchase interface at the time of purchase control that transaction.
6.2 Google Play Billing
Subscriptions purchased through the Android App are processed through Google Play Billing. Google Play processes your payment method and payment credentials. Your use of Google Play is also subject to Google’s applicable terms and policies.
OralDrills does not receive or store your complete card number, bank-account details, UPI credentials, or Google Play payment credentials.
6.3 Automatic Renewal
Monthly and yearly subscriptions are recurring subscriptions. Unless you cancel before the applicable renewal date, Google Play may automatically charge the payment method associated with your Google Play account at the beginning of each new billing period.
Your subscription continues until it is cancelled, expires, is refunded or revoked, or is otherwise terminated in accordance with Google Play requirements, applicable law, or these Terms.
6.4 Price Changes
Subscription prices may change. Any price change will be handled through Google Play in accordance with Google Play requirements and applicable law. Where notice or acceptance is required, it will be provided through the applicable Google Play process.
Changing the price of a plan does not retroactively alter charges already completed.
6.5 Failed or Pending Payments
If a payment is pending, declined, reversed, refunded, charged back, or otherwise unsuccessful, access to paid content may be delayed, restricted, suspended, or removed according to the subscription status reported by Google Play.
Google Play may apply a grace period or account-hold period where available. Access during such a period depends on the subscription status communicated by Google Play.
6.6 Restoring Subscription Access
Where supported, the App may verify or restore an eligible subscription through Google Play. Restoration is subject to successful verification of the relevant Google Play purchase and the associated OralDrills account.
Restoring access does not create a new subscription period and does not override an expired, refunded, revoked, cancelled-and-expired, or otherwise invalid purchase.
7. Cancelling a Google Play Subscription
You may manage or cancel your subscription through the Subscriptions section of the Google Play account used to make the purchase.
Cancelling a subscription normally stops future renewals. Unless Google Play states otherwise, you may continue using the paid subscription benefits until the end of the billing period for which payment has already been made. Access may end earlier if the purchase is refunded, revoked, charged back, or otherwise invalidated.
Uninstalling the OralDrills App does not cancel your subscription.
8. Important: Account Deletion Does Not Cancel Your Google Play Subscription
Deleting your OralDrills account does not automatically cancel an active Google Play subscription.
Your subscription and recurring Google Play billing may continue after your OralDrills account has been deleted. To prevent future renewal charges, you must separately cancel the subscription through Google Play.
Deleting your account may immediately and permanently remove your OralDrills account, course progress, authentication information, and access to subscribed content, even if the Google Play subscription remains active.
We strongly recommend cancelling your Google Play subscription before requesting deletion of your OralDrills account.
9. Refunds
Refund eligibility and processing for purchases made through Google Play are governed by Google Play’s refund policies and applicable consumer law.
Submitting an account-deletion request, uninstalling the App, failing to use the Service, forgetting to cancel before renewal, or losing access because of a breach of these Terms does not automatically create a right to a refund.
Nothing in these Terms limits any refund, remedy, or consumer right that cannot lawfully be excluded.
10. Free Content and Subscription Content
OralDrills may make certain lessons or features available without payment and reserve other lessons or features for users with an eligible active subscription.
The amount and nature of free content may change. Access to subscription content depends on successful account authentication and verification of an eligible subscription.
11. Voice-Recording Feature
The “Record Your Voice” feature allows you to record and play your own voice for speaking practice.
Your personal voice recordings:
- Are created only when you deliberately start recording;
- Are stored locally in the App’s private storage on your device;
- Are not uploaded to OralDrills or our servers;
- Are not accessible to us; and
- May be deleted or replaced using the App’s recording controls.
If you initiate account deletion inside the App on that device, the App also deletes the OralDrills voice recordings stored locally on that device.
A deletion request made through the website cannot delete local recordings stored only on your phone because OralDrills cannot access them. You should delete those recordings through the App on that device.
You are responsible for ensuring that you have permission to record any voice other than your own. You must not use the recording feature unlawfully, secretly record another person, or infringe another person’s privacy or rights.
12. Acceptable Use
You must use OralDrills only for lawful, personal, and educational purposes.
You must not:
- Copy, reproduce, republish, sell, rent, sublicense, distribute, publicly perform, or commercially exploit OralDrills content;
- Download, extract, capture, redistribute, or make lesson audio or protected course content available outside the functionality provided by the App;
- Share subscription access or login credentials with another person;
- Circumvent subscription checks, access controls, screenshot restrictions, screen-recording restrictions, signed audio links, authentication systems, or other technical protections;
- Reverse engineer, decompile, disassemble, modify, or attempt to derive the source code of the App, except where applicable law expressly permits it;
- Scrape, crawl, index, harvest, or use automated systems to access the Service without our written permission;
- Use bots, scripts, modified applications, emulators, or unauthorized tools to interfere with the Service or obtain unauthorized access;
- Introduce malware, malicious code, excessive traffic, or security vulnerabilities;
- Impersonate another person or misrepresent your identity;
- Use the Service to violate another person’s intellectual-property, privacy, contractual, or other legal rights; or
- Use OralDrills for any illegal, fraudulent, abusive, or harmful activity.
13. Intellectual Property
The App, website, course structures, lesson text, question and sentence examples, model audio, graphics, logos, software, design, arrangement, and other OralDrills materials are owned by or licensed to OralDrills and are protected by applicable intellectual-property laws.
The name OralDrills, associated branding, logos, and product presentation may not be used without prior written permission.
Except for the limited licence granted in Section 5, no right, title, licence, or interest in the Service or its content is granted to you.
14. Service Availability and Changes
We aim to provide a reliable Service, but we do not guarantee that every feature will always be available, uninterrupted, secure, or error-free.
The Service may be temporarily unavailable because of maintenance, updates, internet or hosting problems, Google Play services, device compatibility, security incidents, events beyond our reasonable control, or other technical reasons.
We may modify, suspend, or discontinue part of the Service where reasonably necessary. If we permanently discontinue a material paid service during an active paid period, we will comply with applicable law and any relevant Google Play requirements.
15. Devices, Internet Access, and Compatibility
You are responsible for obtaining and maintaining a compatible Android device, a supported operating-system version, internet access, and any mobile-data or internet charges required to use the Service.
Some features—including login, subscription verification, lesson loading, progress synchronization, and streaming lesson audio—require an internet connection.
Device settings, storage availability, microphone permission, operating-system restrictions, network conditions, or third-party service availability may affect App functionality.
16. Educational Disclaimer
OralDrills is an educational practice tool. It is not a school, university, examination authority, employment agency, professional certification body, or provider of regulated professional advice.
We do not guarantee that using OralDrills will produce a particular level of fluency, pronunciation, examination result, academic outcome, employment opportunity, income, or other specific result.
Learning outcomes depend on factors including your starting level, practice, consistency, comprehension, and individual circumstances.
17. Third-Party Services
The Service relies on third-party services, including Google Play, Hostinger, Cloudflare, WordPress components, internet providers, and device operating systems.
Those services may be governed by their own terms and privacy policies. OralDrills is not responsible for a third party’s independent service, terms, acts, omissions, or availability, except to the extent responsibility cannot legally be excluded.
18. Privacy
Our collection and handling of personal information are described in the OralDrills Privacy Policy available through the App and the OralDrills website.
The Privacy Policy forms part of the rules governing your use of the Service. If there is a conflict concerning the handling of personal information, the Privacy Policy will apply to that issue.
19. Suspension and Termination
We may restrict, suspend, or terminate access to the Service where reasonably necessary because:
- You materially or repeatedly breach these Terms;
- Your subscription expires, is cancelled and reaches the end of its paid period, is refunded, revoked, charged back, or becomes invalid;
- We reasonably suspect fraud, account sharing, unauthorized access, security abuse, or unlawful activity;
- Continued access could harm OralDrills, another user, a service provider, or a third party;
- We are required to do so by law, court order, government request, or Google Play requirement; or
- The Service or a material part of it is discontinued.
Where appropriate and reasonably possible, we may provide notice or an opportunity to correct a breach. Immediate action may be taken where necessary to protect security, prevent fraud or harm, or comply with law.
Termination does not affect rights or obligations that arose before termination. Sections intended by their nature to continue—including provisions concerning intellectual property, disclaimers, liability, disputes, and unpaid obligations—will survive.
20. Account and Data Deletion
You may request account deletion:
- Inside the App through the account or profile settings; or
- Through https://www.oraldrills.com/account-deletion/.
Account deletion is permanent and may remove your account information, course progress, authentication tokens, and access to subscribed content, subject to limited retention required for security, fraud prevention, dispute resolution, tax, accounting, or legal compliance.
Account and personal-data deletion are explained in greater detail in the OralDrills Privacy Policy.
21. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
OralDrills does not make warranties that the Service will always be uninterrupted, completely secure, error-free, compatible with every device, or suitable for every individual learning objective.
Nothing in these Terms excludes any warranty, guarantee, condition, or right that cannot lawfully be excluded under applicable consumer law.
22. Limitation of Liability
To the maximum extent permitted by applicable law, OralDrills will not be liable for indirect, incidental, special, consequential, or punitive loss arising from or connected with your use of, or inability to use, the Service.
OralDrills is not responsible for loss caused by:
- Your failure to protect your account credentials;
- Unauthorized account sharing;
- Unsupported or incompatible devices;
- Your internet connection or mobile-data provider;
- Google Play, device-platform, hosting-provider, or other third-party outages;
- Deletion of local recordings through App controls, account deletion on that device, App removal, device reset, storage clearing, device loss, or device failure; or
- Use of the Service in violation of these Terms.
These limitations do not apply to fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any liability that cannot legally be limited or excluded.
23. Changes to These Terms
We may update these Terms to reflect changes to the Service, subscriptions, legal requirements, security practices, or business operations.
The revised Terms will be published on the OralDrills website with an updated “Last updated” date. Where a change materially affects your rights or obligations, we will provide additional notice or request acceptance where required by applicable law.
Your continued use of the Service after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by applicable law.
24. Governing Law and Disputes
These Terms are governed by the laws applicable in India, without limiting any mandatory consumer-protection rights available to you under applicable law.
Before commencing formal proceedings, you and OralDrills should first attempt to resolve the dispute in good faith by contacting the other party and providing a reasonable opportunity to respond.
Subject to applicable consumer law, disputes that cannot be resolved informally will be submitted to a court of competent jurisdiction in India.
25. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
26. No Waiver
If OralDrills does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.
27. Entire Agreement
These Terms, the OralDrills Privacy Policy, the subscription information displayed at purchase, and any additional terms expressly presented for a specific feature constitute the agreement between you and OralDrills concerning the Service.
If subscription information displayed by Google Play conflicts with these Terms concerning the price, billing period, renewal date, or payment processing of a particular purchase, the information confirmed through Google Play will control that purchase.
